Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Polymake Productions website and services (collectively, the "Services"). By accessing the Site, submitting a quote request, placing an order, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

You also agree to our Privacy Policy, which describes how we handle your information and is incorporated into these Terms by reference.

You must be at least 18 years of age and legally able to enter into binding contracts to use the Services. By using the Services, you represent that you meet these requirements.

Polymake provides on-demand custom manufacturing services, primarily 3D printing and 3D scanning. All services are subject to a quote process and acceptance by Polymake before any work begins. The specific scope of any project is defined in the quote and any order confirmation provided to you.

Submitting a quote request does not constitute a binding order and does not obligate you to purchase. A quote is an estimate based on the information and files you provide. Final pricing, lead time, and feasibility are determined after Polymake reviews your files and project details. Polymake reserves the right to decline any project, revise a quote, or decline to proceed at any time prior to order acceptance and payment.

An order is formed when you accept a quote and complete payment (or otherwise as agreed in writing). Polymake must accept an order before it is binding. Polymake may decline or cancel an order if the project is not feasible, the files are unsuitable, or for any other reasonable cause, in which case any payment made will be refunded.

Pricing is set out in your quote. Payment is due as specified in the accepted quote, typically before production begins. Payments are processed through our third-party payment processor. We do not store your full card details. Unless otherwise stated, quotes are valid for a limited time, and Polymake may update pricing for new quotes at any time.

Applicable taxes (such as sales tax) are calculated and added to your order at checkout where required. You are responsible for providing accurate billing information. Tax treatment depends on your location and the nature of the transaction.

Production and turnaround estimates are approximate and depend on order volume, material availability, complexity, and queue conditions. Estimated dates are not guaranteed. We will communicate reasonable updates, but delays outside our control do not constitute a breach of these Terms.

We currently ship within the United States. Shipping methods, carriers, and costs are specified at checkout or in your quote. Delivery dates are estimates and not guaranteed. Risk of loss for shipped items passes to you upon delivery to the carrier, except where applicable law provides otherwise. You are responsible for providing an accurate shipping address.

Because our Services involve custom manufacturing, orders generally cannot be canceled once production has begun. You may request to cancel an order before production starts; we will refund any payment to the extent work has not yet been performed. If you need to cancel, contact us as soon as possible.

Custom-manufactured parts are made to your specifications and are generally non-returnable except where defective or not conforming to the agreed specifications. If a part is defective or does not conform to the agreed specifications, contact us within a reasonable time of receipt. At our discretion, we will reprint, repair, or refund the affected part. We are not obligated to refund or reprint parts that conform to the agreed specifications but that you later decide you no longer want.

Custom-manufactured parts are produced according to the agreed specifications. Fused deposition modeling (FDM) 3D printing typically achieves tolerances around ±0.1mm, but actual results vary based on part geometry, material, orientation, and other factors. Tolerances are not guaranteed unless specifically agreed in writing for your project.

Color, surface finish, and appearance may vary between prints and from on-screen representations due to material batches, printer variance, and the nature of additive manufacturing. Minor cosmetic variations that do not affect function are not defects.

Unless we expressly agree otherwise in writing, parts we produce are custom-manufactured items based on your design and specifications. They are not certified, tested, or warranted for any particular end-use application, safety-critical use, medical use, automotive use, aerospace use, or regulatory compliance. You are responsible for determining whether a part is appropriate for your intended application and for any testing, validation, or certification required for your use.

You are responsible for the suitability, correctness, and printability of any design, CAD, STL, STEP, drawing, or other file you provide. Polymake does not automatically represent that a customer-designed part is safe, structurally sound, functional, or suitable for any particular purpose unless we have expressly agreed in writing to provide engineering, design, or validation services for that part.

If you request engineering review or design assistance and we agree to provide it, the scope and responsibility for that work will be set out in your quote. Otherwise, production is performed based on your files as provided.

You retain ownership of the designs and files you submit. By submitting files to Polymake, you grant us a limited, non-exclusive license to use, reproduce, and modify those files solely as necessary to quote, manufacture, inspect, fulfill, and support your order, and to retain records as described in our Privacy Policy. We will not use your designs for marketing or public display without your separate permission.

The Site's content, branding, text, and software are owned by Polymake and protected by applicable intellectual property laws. You may not copy, reproduce, or use them without our written permission.

By submitting files or placing an order, you represent that:

• You own or have the legal right to use and reproduce the files and designs you submit.
• Your files do not infringe the intellectual property rights or other rights of any third party.
• The content of your files is not unlawful, defamatory, or otherwise prohibited.
• The information you provide is accurate and complete.

You may not use the Services to produce anything that is illegal, infringing, dangerous, or that you do not have the right to reproduce. This includes items that infringe trademarks or copyrights, counterfeit goods, weapons or components regulated by law, or any content that violates applicable law. Polymake may refuse or cancel any order involving prohibited or questionable content at its discretion.

You agree to indemnify and hold Polymake harmless from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the files, designs, or content you submit; (b) your use of the Services; (c) your violation of these Terms; or (d) your infringement of any third-party rights, including intellectual property rights.

The Services and any parts we produce are provided "as is" and "as available," except for the express representations made in your accepted quote. To the maximum extent permitted by law, Polymake disclaims all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that parts will meet any particular performance, safety, or regulatory standard unless expressly agreed in writing. You are responsible for validating the suitability of parts for your application.

To the maximum extent permitted by law, Polymake's total aggregate liability for any claim arising out of or related to the Services or these Terms shall not exceed the amount you paid to Polymake for the specific order giving rise to the claim. In no event will Polymake be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunity, even if advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations of liability. To the extent any such limitation is prohibited by applicable law, it will not apply to the extent prohibited.

Polymake is not liable for any delay or failure to perform due to causes beyond our reasonable control, including but not limited to natural disasters, equipment failure, material supply disruptions, power or telecommunications outages, labor disruptions, pandemics, governmental actions, or other events outside our control.

The Site includes an AI-powered chat assistant. Responses are generated automatically for general informational purposes only. They do not constitute binding quotes, professional engineering advice, or warranties. Always confirm details through the formal quote process.

Polymake may suspend or terminate your access to the Site or refuse to provide Services at any time if you violate these Terms or for any other reasonable cause. Upon termination, the provisions of these Terms that by their nature should survive will remain in effect, including those regarding intellectual property, indemnification, disclaimers, and limitation of liability.

These Terms and any dispute arising out of or related to them or the Services are governed by the laws of the State of New York, United States, without regard to conflict of law principles. The parties will first attempt to resolve any dispute through good-faith negotiation. If the dispute is not resolved through negotiation, it will be submitted to the state or federal courts located in Suffolk County, New York, and you consent to the exclusive jurisdiction and venue of those courts.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

These Terms, together with the Privacy Policy and any accepted quote, constitute the entire agreement between you and Polymake regarding the Services and supersede any prior agreements or understandings regarding the same subject matter.

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
